Here you regulate whether the appointed person can decide on detention (e.g. in a psychiatric hospital) or other measures depriving you of your liberty (e.g. bed rails, tying up, sedative medication).

These measures are only possible if there is a risk of self-harm or suicide. If these conditions no longer apply, the measures must be terminated.

In this section you determine whether the appointed person can consent to medical coercive measures. A medical coercive measure is an examination or treatment against the will of an adult person

A medical coercive measure is only permissible under Section 1832 of the German Civil Code if there is a risk of significant damage to health if the examination or treatment were not carried out.

In this section you regulate whether the appointed person can decide on your stay and housing matters.

Stay means the place where you live, for example at home or in a nursing home.

In this section you decide if the appointed person can manage official or insurance-related matters on your behalf. This applies to activities such as taking a new insurance policy on your behalf, terminating a contract, etc.

In this section you determine whether the appointed person can manage your assets on your behalf.

The appointed person must act in your interest at all times and may not use the assets and money for their own purposes. The appointed person may only make gifts from the assets if this is in accordance with your wishes. If the appointed person acts against your will, claims for damages may arise.

You have two options:

• You can transfer the entire asset management to the appointed person.
• You transfer only individual asset management tasks.

NOTE: For real estate matters you (the grantor) must get your power of attorney certified from a notary. Without a certified power of attorney, the appointed person may face complications relating to real estate transactions, commercial business, or taking out consumer loans.

Mail/post must be treated confidentially in Germany. Letters and packages can only be delivered, handed over and picked up to the recipient.

In this section you (the grantor) decide whether the appointed person can accept and open your letters and packages. This also applies to shipments marked personal or confidential.

In this section you determine whether the appointed person can delegate power of attorney to another person.

There could be a possibility that the appointed person is temporarily unavailable. Thus, you allow the appointed person to determine who will represent you if necessary.

The power of attorney (LPA) is by default valid until your death. However, it may be useful if the LPA continues to apply after your death.

Your heirs can only take action if you have a will or certificate of inheritance. Thus, in LPA, you can specify that the appointed person can manage your affairs, such as funeral, until the power of attorney is revoked by the heirs.

The appointed person will need your user IDs and password to access your online accounts, such as email, social media, etc.

It is therefore advisable to document your user IDs and passwords. You should also update them regularly.

Lastly, store the document in a place where the appointed person can find it in an emergency.
